1. Acceptance of Terms

By accessing or using Prompster ("we", "us", "our"), a SaaS platform available at https://prompster.xyz, you ("you", "user", "customer") agree to be bound by these Terms and Conditions, our Privacy Policy, and any other legal notices or policies displayed on our website.

If you do not agree to these terms, you may not use our services.

2. Services Provided

Prompster provides access to a software tool that helps users improve their AI prompts. Users are granted limited, non-exclusive access to our digital product based on their selected subscription plan.

You may try Prompster for free using up to 5 prompts before subscribing.

3. Eligibility

You must be at least 16 years old and capable of entering into a binding contract under applicable law to use our services. By using Prompster, you confirm that you meet these requirements.

4. Account Registration

To access certain features, you may need to register an account. You agree to provide accurate and complete information and to keep your credentials secure. You are responsible for all activities under your account.

5. Subscriptions and Payments

Access to Prompster is provided via a paid subscription.

Payments are securely processed through Stripe.

By subscribing, you authorize Prompster to charge your payment method on a recurring basis according to your selected plan.

All prices are in USD unless otherwise stated.

6. Free Trial

Each user is entitled to 5 free prompts to evaluate the product.

This free trial is optional but highly encouraged before purchasing a subscription.

Subscriptions made after using the 5 free prompts are considered final and non-refundable (see Refund Policy below).

7. Refund Policy

We want our customers to feel confident in their purchase. Please review our refund policy carefully:

Eligibility for Refunds

You may be eligible for a full refund under the following conditions:

• You have not used the 5 free prompts.
• You request the refund within 7 days of your initial subscription purchase.
• You have not generated more than 5 prompts in total (paid or free).

Non-Refundable Circumstances

We do not offer refunds in the following situations:

• You subscribed after using the full 5-prompt free trial.
• You used more than 5 prompts (including free and paid) after purchasing.
• Refund requests made after the 7-day period.

This policy is in place to protect our business and ensure fair usage of our free trial system.

How to Request a Refund

Refunds can be initiated through the Stripe Customer Portal:

• Log in using the magic link you received upon purchase.
• Navigate to Billing or Subscription Settings.
• Follow the instructions for canceling or requesting a refund (if eligible).

Refund Timeline

Approved refunds will be processed within 5–10 business days, depending on your bank or payment provider.

Fees

There are no refund processing fees. However, currency conversion or bank processing fees (if any) are not covered by Prompster.

8. License and Intellectual Property

All content, tools, software, and other intellectual property associated with Prompster are owned by or licensed to us and protected by applicable intellectual property laws.

You may not reproduce, redistribute, modify, or reverse-engineer any part of our service without express permission.

9. Acceptable Use

You agree not to:

• Use the platform for illegal or harmful purposes.
• Attempt to gain unauthorized access to our systems.
• Interfere with or disrupt the services or networks.
• Circumvent our subscription limits or abuse the free trial.

Violating these terms may result in suspension or termination of your account.

10. Termination

We may suspend or terminate your access to the platform without notice if you violate these Terms. You may also cancel your subscription at any time via the Stripe Customer Portal. Upon termination, you lose access to your account and associated data.

11. Disclaimer of Warranties

Prompster is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee that the service will be uninterrupted, error-free, or meet your expectations.

12. Limitation of Liability

To the fullest extent permitted by law, Prompster shall not be liable for any indirect, incidental, special, or consequential damages, including lost profits, data loss, or service interruptions, arising from your use of the service.

13. Changes to Terms

We reserve the right to modify these Terms at any time. If changes are material, we will provide notice via email or website notice. Your continued use of Prompster after such updates constitutes acceptance of the revised Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Indonesia, without regard to its conflict of law provisions. Any disputes shall be resolved in the competent courts located in Bali.
